hard thing to do a hard thing either to innocent or guilty in any case in which
some special and serious danger, he can be Penalty
entrusted with the power requisite to enable him
to steer clear of both those inconveniences. To
keep the Magistrate in the right road, in many
cases where words of obligation would run counter
to the purpose, words of direction and instruction
would be as use serviceable as the use of them isthey are unexceptionable.
Of these the use is not yet so frequent
as it were to be wished. It being the peculiar
provinceprivilege of the legislator to command, it the exclusive function
would be a departure from character (it seems to
be thought) if he were to move the pen for any other
purpose: and thus it is it happens that the Magistrate is so
often left without direction, where direction is all where obligation would do more harm than good.

is liable continually to miss his way, merely
for want of knowing what the legislator has in
view.
