one Justice — Form

§. And be it further enacted that every
information for the proceedings on every information
given of any species committed against this Act
and all other proceedings judicial proceedings to be which shall
carried on under grounded on this Act, may in
except in such cases in which it is herein otherwise
provided, be carried on and the matter thereof determined, by or before any one or more
of his Majesty's Justices of the Peace acting in and for the matter hereof determined
the County or other local jurisdiction in which the
ground for such proceedings shall arise: and every
such Justice of by w before whom any person shall be committed
as aforesaid of any such offense may cause the
conviction to be drawn up in according to the form of words
contained and described in the Schedule marked [ ] and hereunto
annexed, or not according to any other form
of words to the same effect: and after the for levying
or causing to be paid any every such penalty which sum as any
person shall be adjudged to pay, whether under the
any such offender shall have been convicted such
name of a penalty, or of costs, or both or on any other account
it shall and may be lawful for such Justice or
Justices to proceed either by Distress and Sale [+] [+] a (if by examination
of the party or
[+] in case otherwise it should
appear to such Justice
or Justices that no
sufficient Distress is
likely to be obtained)
then and in such case
whatsoever[+] [+] by
committing the party that party in the first instance to any prison or [+]2 or if such sum
to be levied as
a penalty for
[+]2 (in case of
conviction for any
such offence) any to any House of
Correction, within the jurisdiction of such Justice or
Justices for any time not greater than [two] months [twelve] weeks
or until such penalty unless determinable upon the payment of the money so to be levied: be
paid: or in the case of conviction for any such offence
such Justice or Justices may at their discretion
committ such offender as aforesaid in the first instance for any term
not excluding [one six] month weeks and moreover cause
him adjudge him to forfeit and pay and such thereupon [+]3 [+]3 by distress and sale, or imprisonment
for not more than
six other weeks cause
him or her to pay
to pay [+] in manner as aforesaid any sum not exceeding
the half of the amount of the greatest sum forfeiture which in each respective
case
