Police Bill Observations
Shall the power of sanctioning the By-laws
insinuating with the Board be committed as here
to the superior Judges, or to the thing in General.
If to the superior Judges, shall the section near
the form and complexion of that the sections in the
statute of Queen Act that suggested the idea of it,
is near an independent form, is governed not so
much by the idea of conforming consideration of their precedent, as
as by the consideration of the end in view.
Reasons against the giving the power to the judges.
1. Difficulty there may be in engaging them separately
to pay the requested attention to the subject and collectively
to hold meetings for the purpose, confused
as their time is already. 2. In this way they
will unite it may be thought by some rather too
closely the legislature and judicial functions: directly as individually
as judges of its infractions or supposed
infractions of the By-laws sanctioned by them in their
legislative capacity
Reasons in favour of the giving the power to the Judges
1. Advantage of an precedent directly in point: and
a precedent which has never given occasion of complaint.
2. Power of greater latitude will be given
when secured against abuse by those which
would perhaps be given in the other case.
The circumstance in which the chance of obtaining
the requested trust and confidence from Parliament
seems principally to depend is the consideration that
the persons thus proposed to be subjected to regulation
are
