otherwise. If the marks respectively in use are
such as in every instance are sufficient to answer the purpose
here here in view, in that case the business of the
Board will be confined to the registering of the such
already existing marks: but if in any instance they should be
found to fail of being adequate to this purpose,
then then, so far as this is the case in that case proper and adequate marks
will require to be prescribed. Then and not till
then individuals may be prohibited under penalties
from having in their custody masses of the
matter in question unprovided with such marks.
But if there be one a single instance in
which a mass of the sort of sort of article in question
comes from the hands of the lawful founder
unprovided with undistinguished by any such mark, in that case
it is evident that a regulation subjecting the
individual to a penalty for having in his possession
an article of the sort in question undistinguished
by such sort of mark in question, can not but be
productive will be
productive of mere

vexation, without
contributing any
thing to its intended
purpose.
