§ 4. [ 1 ] [ Necessary and convenient ] The words in between inverted

§. 1 relative to Ale-house licences. The use of them
is to give to the Board of itself a general power of
framing regulations for the regulating the conduct
of the several classes of persons in the exercise of their
respective occupations the general power of regulation
for the reasons already given in the Preliminary Observations.

favour of this precedent such a power will be
thought fit to be conferred is a matter of experiment:
should the experiment fail, or be deemed unfit for trial, then will come
another experiment, whether a similar power will
be conferred, subject to the sanction of the four principal
Judges, according to the precedent established in the case
of Hackney-Coach-keepers, and referred to with approbation by the Committee
of Finance. When the two cases come to be
compared, it does not appear to me, that either the
demand, for such a general and unfettered unfettered power, will be found to be
less urgent in the cases here in question than in the
case of Alehouse keepers, nor that the dangers of to be
apprehended from the possession of such a power
are greater in the present case, (considering the checks to which the
conduct of the proposed Board will be subject) than
as in that case, where it is given to country meetings of Justices
sitting scattered all over the Kingdom, and in
situations many of them very remote from the scrutiny
of the public eye.
