the Sureties, as well for their own selves as for that of their
friend, would find themselves prompted to use their endeavours
to screen him, by motives which do not a
for the countervailing of which no counter-inducements
appear to have been provided. Under
the provision here proposed, it may be made the
interest of the Surety, to give up contribute to
the bringing of the Principal to justice instead of rather than to
strive to screen him for it - An Officer of Police
Revenue may say to him —
We know
that the man your are surety for is going on in
an illegal course: if evidence is obtained against
him without your assistance your the penalty of
the Recognizance will be levied upon yourself as

obtain sufficient evidence against him I will take care
and represent the matter in such manner that
you finally shall be remitted.

the Recognizance considerable enough to be pos

meant to operate, the unsusceptibility its unsusceptibility
of mitigation being mitigated (under the course of procedure
marked out by the act) in case of venial delinquency
or poverty, would be a
considerable objection to it: whereas by the power
of mitigation here proposed (as above) to be extended
to the case of the Surety, as well as to that of the
Principal, this objection is removed.
