Convicts not to
be licenced
Observations on §
§ 1. [ No licence ] § [ ] [ No licence ]. p. 1.
To give this cause its full effect it would be necessary
the Board should be in possession of a compleat list
or register of persons convicted of the offenses in question.
But this is a register document which they ought to be put
in possession of not the only one by a great multitude of purposes for which such
a Register would be necessary: and for this reason this
for which reason, as well as for on account of the
length of detail which it would require, it could
not presume to that effect could not conveniently
be brought within the compass of the present section

"Hawker . . . . shall . . . . forfeit his or her Licence, and
"for ever thereafter be incapable of obtaining or holding
"any new Licence." . . . .
While The principle of this precedent has been adopted, what
appeared to be the defects in it have been endeavored
to be corrected.
Under this clause it might be a question, whether
this case were or were not ousted of pardon: concerning
which see the question about the admissibility of an evidence
after conviction of Perjury. While offenses of so
much deeper dye, and with corresponding punishments of so much deeper greater
severity are not ousted of pardon, there seems no reason why
that power of remedy against unmerited or unnecessary sufferings should be taken away in this case, especially
as among the grounds for pardon is the persuasion of innocence,
the merits proofs of which will, notwith, even without any
impeachment of the propriety of the conviction, be sometimes
brought to light.
The modification condition
here proposed to be
applied annexed to the power
exercise of the power
of pardoning in this
case will (it is hoped)
be found capable of answering every good purpose, that
would be answered by the taking it away
altogether.
