§. 3. [ 2 ] p. [ Peace-Officer ] If the power in question were
to be communicated to the Officer of the Board, in like condition
of his conveying it (as a Peace-Officer would do) the
persons and things in question before a Justice, there
seems no danger of abuse, since it does not seem
likely that any
person should be

thrown on the Defendant in a thousand instances: and
the present appears to be of the number of the instances
in which if this were not done, no conviction could take
place a case in which under the safeguard here
provided no danger can arise to innoc injury need
be apprehended from such a clause.
