If the possibility of abuse were a sufficient
ground for the refusal of this compound
punishment, neither of its elements would be
punishment, no sufficient warrant could be found
for the employing of either of the elements of singly
which it is comprised. To a man Distress and
Sale (for in these cases Distress is never
can never be made ordered without sale) is of itself
a grievo capable of being made a grievous
punishment: the waste and other expences
equal at least if not much more than equal
to the produce: and the family distressed perhaps
of articles for which it would hardly have accepted
of any price. To a man of character
and feeling, imprisonment be the term ever
so short, may be still worse imprisonment
were it only for the ignominy may be still
worse. Could it be known beforehand that this
or than pers a man would be both able and
willing to submitt to and pay a fine, neither
ought ever to be allowed. would be to be endured. But this among
whether A or B Notes or possesses both
these other qualities is among the things which
the legislator as such must never hope to can ever know.
To determine To judge in each the instance of each offender whether responsibility that sort
of responsibility does or does not exist, and to
act accordingly, is therefore a power which can
not be refused to any Magistrate.
