In regard to Gunpowder
the
existing Laws
operate in the
way proposed
though inadequately
With regard to Gunpowder, restrictions of great force
and which with a view of the object here in question
would be found upon of great and salutary efficacy have
been established by other Statutes, consolidated by a Statute of the present reign: restrictions
all of great force and which with a view to the object here
in question would might upon occasion be found of great and
salutary considerable efficacy, though the only object proposed to be ha
pointed at, and perhaps the only object in view, was the
in the framing of them restrictions was the guarding
against accidents by fire mischance or negligence. By 12.Geo.3 ch. 61
§ 11, more than 200lb at a time is not to be kept together at a house
even by a Dealer, not more than 50lb by any other
also persons individual at large in any one place within three miles
of London or Westminster, or within one mile of any other
Market Town in Great Britain, a form of under a
penalty of 2d per lb for the overweight and forfeiture of
the powder, with powers of search and seizure. But this,
though a considerable check, would not be an adequate one:
because any quantities might notwithstanding be kept
without
those limits, and even within them, so long as they were
distributed in parcels of less than 50lb weight each in different
houses not actually contiguous.

— So, in regard
to Artillery
In regard to Artillery, the Statute relative to Highways
(12.G.3.c.78) contains a clause applicable to this purpose, though
perhaps not established in this view. After limiting
the weight capable of being carried on any one carriage by
limiting the number of beasts of draught capable of being
put to it, it establishes certain exemptions in favour of certain artillery among which
is "such ammunition or artillery as shall be for his Majesty's
"Service": that being the case, ammunition or artillery not being
for his Majesty's service remains unexempted . But this, though like
the former check, fails as like the former to be of being an adequate one: since by using
wheels of a certain breadth a man may draw Guns artillery of any weight he pleases; [+]
[+] besides that here the timely remedy by seizure being wanting, the tardy remedy by action or information would not come up to the purpose.
