In the consideration of the means to be employd
for giving efficiency to bringing into action the system of controul above
exhibited, a very important topic that requires to
be clarified is that which concerns the degree and nature
species and extent of regulative authority of the powers of regulation if any to be which shall
be given to the Board — [The types of regulation
may be limited or unlimited specified or unspecified — the person whose of
conduct shall be subject to regulation]

Not advisable to
grant the Board powers of
legislation bearing
upon all persons
in general

In the Report of the Committee, a limit point is
thrown out started as a subject of further inquiry, whether a spe
portion of legislative authority (subject not only to the general
and occasional controul to which all the Board is to be subjected
in respect of all its operations without exception, but
also to the special and inseparable controul therein mentioned [+] [+] viz: the conc express approbation of the concurrence of the four principal Judges shall
not be entrusted to the Board, exercisable over all
persons without whatsoever exception distinction with reference to certain
types of regulation therein specified. Fix a

the demand for it does not appear urgent, the repugnance
towards it seems likely to be strong and

whole the objections to the attempt of introducing
any such measure ingredient into the system, or some at present themselves
for the present at least, and antecedently to the establishment
of the Board, as altogether unsurmountable too strong
to be contended with.
