not known to the accused a witness accusing witness
examined viva voce is not in detail, as it might may
happen—examined viva voce or not, as
it might happen—accusing witness not so
much as confronted with the accused — not
cross-examined by the accused — trial, not public:
no law or written declaration or other accessible or existing document,
with or without the force of law by
which a man can tell what species of conduct
will and what will not be regarded as an offence
— to crown all — the securing witness not examined,
nor so much as examinable, upon oath.
The latter circumstances so remarkable. The Statute
has been examined, and in vain, for a power
to this purpose. To what cause is the omission to
ascribed? — Was it overnight? — Was it the apprehension
of start of its being no Parliament's being startled
at it. Whatever may have been the cause,
such is the effect, that the officer who supreme
master of the existence of so many thousands
has neither has no sufficient means
in his hands for doing justice either to the individual
subjected to him or so much as to the public for whose security
the subjection is established.
