Nature of the mischief in the case of informal declarations
Recension the case where the declaration
is of the informal kind:
Where the declaration
is informal —
Here the mischief is the same in kind in specie
the same: differing only in degree.

In the case of insincerity, the transgression against
the laws of probity is the more aggravated, the more
greater the force with which the intensity of the attention has applied
itself to and taken cognizance of bestowed examination upon the subject: In
the case of the creed, this force is at its maximum.
In the case of the informal declaration, at the assent
will frequently be rather implied than express: or the
act of assertion will be performed rather by implication, and in the way of collateral assumption,
than in the way of direct asser averment. Where it is
thus in the way of implication or inference that the intimation
is expressed and conveyed, the less necessary the implication,
the less strong is the hold which it shews
the to have been taken of the subject by the attention
of the party declarant those declarant — the person by whom the declaration is made.
