1821 Septr 27 To Arguelles on Juries
The sort of body called a Jury should it in any case
have place in the Judicial establishment, if yes, on what occasions
& on each occasion what is the shape in which it may
be employed to most advantage, add then may with most
advantage be given to it.
Ends of Judicial Procedure — elements of appropriate
aptitude on the part of the functionaries employed in that
department for the attainment of those ends, distinction
between penal & non penal cases with the corresponding
procedure — distinction between the higher & lower orders of
society, these are the Topics from which, principles for the solution
of those questions will be required to be deduced.
