In regard to this matter I would venture to propose recommend
submitt to nature the following alterations
1. So far as concerns functionaries not ecclesiastical
state in Article by itself reference to the several Articles
descriptive of the offences in regard to which the loss of office
is in the case of a public functionary designed to make
part of the punishment. Of public functionaries, paid as they
are and otherwise rewarded for being what they are, it is not
too much to expect that an article to this effect howsoever it may be in regard to other arrangements,
an article
to this effect should
have been received taken with
this conception and
kept in their memory mind
especially considering
how necessarily it is
suggested to every
consideration by the
very nature of the case
2. In regard to functionaries Ecclesiastical state in
one Article a description of the offence which they would
committ by making use employing the influence attached to their
sacred function in disposing men the preparing men
for resistance to aggression against the power of government in the whole or in
any branch of it: a description of the offence, and in
the same Article a designation of the punishment attached
to it
To the d of the Article thus occupied give a temporary apply a determinate
directive. limit. If the in other particulars the Spanish Constitution
produces its expected good effects, thus
made of religious influence will no longer be productive
of any mischievous effect. The body of the law may then
be disencumbered of it: disencumbered without loss, and
therefore with advantage.
