To this will be added the two concluding Chapters intituled
Local Headmen and Local Headman's Registrars, in
whose duty are comprised functions some of them belonging
to the Administration Department as well as to the
Judiciary.
In the nature of the case most intimately interwoven with
and dependent on each other are the matters of the
Judiciary Establishment, and that of the system of
Judicial Procedure. Of this last I have lately given
the whole field and settled with myself all the most
material points, but have not yet found time to bring
it from the original rough state into one in which it
can meet the public eye. It is what I shall go
upon next, as soon as the whole of the Constitutional
Code is brought into a publishable state for which if I
have a very few months — not to say weeks — will I trust be sufficient.[+]
[+] Something of the general complexion
of it will be is I hope,
visible upon the face
of the matter of the
Judiciary Establishment.
So likewise with regard to the Penal Code, all
the material points have long been settled, and a considerable
quantity of the matter is already written. You possess, (I
have been am told) a copy of Mr Livingston's Draught of a
Penal Code, in which (I am told) he speaks of it grounded
principally on what belongs to that subject in the Traitis de Legislation the first
of those works of mine which have been published by Mr
Dumont in French. If not by this conveyance, by the next I
will send you a Table of Chapters and Sections of my
proposed Penal Code, on the same plan as that of the the abovementioned one of my Constitutional
Code: in the mean time I make no doubt but that considerable
assistance may be derived from that work of Mr Livingston's.
Almost any law is better than none: and I should imagine the
best thing you could do would be to give adoption, all at once, to that Code:

But whatever you do
you would rather expressly declare it temporary (as we do here) than attempt to render it perpetual as the poor Spaniards did, their sadly imperfect inadequate work.
