into operation, conduct is taken out of the regions of virtue & vice.

In insanity where the thinking powers are overthrown. In rather if
their case is their there is no responsibility & consequently consequently no title
can be made out to praise or blame. In the case of temporary
aberration of the reasoning powers as under the influence of
intoxication – the actor is not responsible for the act committed
while his judgment is as it were extinguished. It is a secondary
consequence of a primary imprudence. In the case of insanity the
course of to be pursued by society is clear, – the power of voluntary
action must be taken away. In the case of infancy the demand
for impunity must depend on the quantity of mind which is developed
& it will be found that at a very early age the influence of pain which is
made to visiting misconduct may be brought into operation, – & from the
moment that such discipline becomes operative, there is a
demand for its application. In the case of acts committed
under the influence of inebriety while less is there is no claim
to impunity – nor can to any general rule be laid down which shall
be applicable to every case. All the sanctions must be consulted
in order to exact the sufficient penalties for the past & to obtain the
most appropriate securities for the future.
