ReviewVIII IX Nomography
4. Inadequate
Ambiguity excluding clauses.
In §.105. Provision for clearing the text of the law Statute Book from the ambiguity
liable to be produced by the customary classical forms of speech
In an all comprehensive Code such as that of which in the Bentham stile
Bentham was the first to hold up to view, once for all would
all those matters be settled: subject-matter thus for a correspondent
part division head of the Institute of Nomography, forming part and parcel of that same Code.
In the Peel stile, and imitation of it in
the Brougham stile, this is to be done in here and there an
Act. wherever it happens to come into a when it happens
t of it, yes be thought of, yes; when not, no.
Imperfect and inadequate is the provision made by
one learned legislative draughtsman under in relation these several heads subject matters: species
of uninstructedness of tyroship and want of discernment the same as that which concealed
from his eyes the need of appropriate provision for
the cases where as above-mentioned one side of a cause or on both, there
are parties more than one.
Here too may be seen an example of a feature of
inaptitude which runs through the whole composition, provision
which to be stiled if expressed clearly would be consigned
to so many different Articles, lumped together under
one.
But of no part of the field of precision – of no part of the
matter with which it requires to be covered are
any token exhibited by it: of every part an indistinct and a
confused one: packed up and huddled together any how are the several arrangements from
this or that part of the existing chaos.
