§. VI.Attachment causes

Under matchless constitution the form which
depredation assumes when in employ found in the instrument employed by it, the course a man takes in the practice
of it the manner in which it is dealt with by law, and consequently the course a man takes for the effectuation of it depends upon his situation with relation to office.
To obtain money or moneys worth the matter of wealth by fraud is to obtain
it by false pretences. In point of fact this pretious matter
is obtained by false pretences in two says, without cover of law, and
under cover of law. When the obtainment is effected
without cover of law, it has been made punishable by
modes of punishment the place of which in the scale
or nev stands near to that of death: it has been made
punishable
by transportation, with the option between that
and the being exposed in the public and the being whipped.

But in England, the higher orders, in the situation
of legislators have by the in some instances by position
have in others by connivance enabled themselves to an
immense amount to obtain the money of the lower orders.

All money which is received in and for remuneration
appointed for labour performed in a case in which in
truth no such labour by the individual receiving it no
such labour is performed, is obtainment on false pretences.
In various works, I have had occasion to show how by
Judges of various descriptions and their subordinates by whom
in England is administered what is called justice money
to vast amounts is extorted and thus obtained on false
pretence if in this instance execution and effect were
given to the undispectedly and indisputably existing law
they would all of them be whipped, pilloried or transportalbe.
But Judges will not whip pillory or transport themselves
or one another: and thus, so far as regards
the higher orders the what would the law such part of it
the execution of which would be unpleasant to them, remains
a dead matter, and everything is as it should be.
