§ v Vin A. fourth increasing all malifaculy effects of the thirty of the power
of pardoners

1. Fertile in evil is the power of pardoning, unless
fertile as you will see it to be more there is commonly imaginuly
unless restricted by all applicable checks: power of pardoning
that is to say if power of remitting the punishment appointed
by law: fertile to whatsoever per whatsoever be the mode
of punishment to which it is made applicable; and to
this disastrous fertility great as you will see is the
addition made by the admittance of death on the list of punishments giving to death punishment
admission into this list of punishments in use

2 Instead of saying power of remitting punishment, within
cases when that power fails as not restricted by
in a case in which any check applicable with advantage
to that same power fails if being applicable to it
let us say for shortness power of pardon where named, or
insufficiently not aptly and sufficiently restricted power of pardon: what then
checks are you will see presently.

3. Of punishment the man use is to lessen the number
of crimes committed thence the aggregate quantity of human suffering
produced by them. In for the present purpose it may
be considered as the only use. an inferior use of it, namely by affording
an ear by the view of it satisfaction in a certain shape to the an individuals
who have been a sufferer by the offence punished, not being
on the present occasion worth consid any further consideration

4. From power of pardon where as above named fl
evil in two distinguishable shapes. namely impunity
given to crime thence increase with given to the quantity of crime
committed and of human suffering produced by it: and
increase given to the powerquantity of the of corruption in the hands of
rulers: thence to the quantity of misrule in all its several shapes,
and the quantity of evil in all shapes produced by it
