J.B. against to France against Death Death
9 Execution

19
Apt checks, what
1. When it would be
groundless, obligation
to check and make
known the evidence
as well as the fact

Now the these seen apt and sufficient restrain - what
are they? Answer. In the case where by subsequential evidence
the punishment it is shown would if inflated be groundless
the obligation of making known this same evidence: making it
known as effectually as the evidence in the ground of which the
order for the punishment was given or would have been given,
was made or could have been made known if made for
the case when it is in the supposition account of its groundlessness that the
punishment is remted

20
Where the evidence
can not be elicited
and made known
publicly given to make
of the facts viz
1. Multitude of Codelinquents

In the case where the ground is constituted by the multitude
of the offenders, there would be the necessity of stating the number of
them, in respect of each of whom the elucidation and publication of the evidence
would be requisite: not in this case a licence
would be given for misuse in the case of all those every number
beyond the number particularised.

In the case where thoug it is by the supposed
disposition and eff relative state of the affection on the part of the people
that the ground is established, the impeachability of
in all cases and making public thean appropriate body of evidence
is sufficiently appo manifest: now less so is the
uned state of things would have place if it
were necessary to state whither it was the favour of the people
that were courted in this disfavour that were formed.

To the case where the disposition of some foreign power
is the object looked to the same this observation will make
little difference will be found applicable.
