4. Second Chamber, none.

5. If however, Second Chamber there must be, members of it not
hereditary.

6. If not hereditary, so neither for life.

7. If for life, appointed not by the King but by the same
electors as those by whom those of the First Chamber are
appointed.

8. If not for life, by whomsoever appointed, the shorter
the term for which they act sit the better. So as to those
of the first Chamber; so also as to those of the Second.

9. For giving execution and effect, contested cases excepted,
to the ordinances of the legislative authority, emission of
particular orders and to of subordinate functionaries
in the several sub-departments included, a
single functionary whose proper appellative is in
my view of the matter The Prime Minister.

10. Of this supposed Prime Minister the authority coincides
pretty nearly with that which in the Anglo-American
United States belongs to or is exercised by the President:
a denomination I cannot bring myself to employ, it
being unappropriate and delusive. In the French
Constitution, the President of the Chamber of Deputies
sits among out and presides over, sits with and above
the other Deputies. The President of the Congress, who
does he preside over? Nobody. Never does he sit
in that same Congress: with that Assembly no otherwise
does he hold intercourse than by message.

11. Name of the Prime Minister's Department, the Administrative.
Under him Sub-departments, 13, headed each by a Minister. Subject
matters of their authority – 1. Elections – 2. Legislation – 3. Army –
4. Navy – 5. Preventive Service – 6. Interior Communication –
7. Indigence Relief – 8. Education – 9. Domain – 10. Health –
11. Foreign Relations – 12. Trade – 13. Finance.

12. At the head of the Judiciary Department, a single
functionary, the Justice Minister. Subject matters of his
authority, all contested cases.

13. Composed of Administrative and Judicial authority
taken together, the Executive.
