even thus, by being to appearance apparently inexhaustive,
it is unsatisfactory and incomplete. Rights
exercisible any by persons is Good: but over whatr
it may be over things, as well as persons

but by whom? It must be by persons.
Right as against Persons — Powers over Persons
Powers over things: are Rights exercisible
over things against persons
To place the distinction be of import between the
two terms in a clear light, it is necessary to
bring in that an idea which is common to them
both: that this idea is that of punishment. Power
over persons is the faculty either of inflicting or preventing punishment
or of concurring on a certain way to inflict
or prevent it, by the immediate suggestions
of the party's own will who has the power. Right is the faulty
of them causing punishment to be inflicted at
the suggestion of the Will not of the party himself who has
the right but of some other party to whom he is
obliged to apply address himself, and on whose will it immediately
depends.
A Right is the faculty of having punishment
inflicted in the arbitrament of some other third person on him who shall do any such act
as if done would be said to be an invasion
of that right.
