Formalities - End
to be considerd
In the expression and the attestation
Certain formalities are required: others whether required
or no are habitually observed.
The point to be considered is, to what perspective are they required to what end purpose
ought the observance on them to be insisted on.
For all of them that are of any use There is some assignable end on which the observance of them
is calculated to answer. For every one of them
some such end is to be assigned/assignable ought to be found. Take any
one of them, if no such end is to be found
for it, it is not merely useless, it is mischievous.
Those that have
none mischievous
The effect of it Be it what it may there is a chance of it
being omitted. Where it is observed the observance
of it breeds voluminously, absurdity, trouble
and delay. There it is not omitted, the effect
of the omission (or else it is not such a formality
as are suppose) is to defend the intention of the
parties. It is to occasion a Pain at least to one party
if not to many: A pack of disappointment
it is to frustrate the purpose of the Law that
sanctions contact: those and of which law was
to prevent such Pains
