The intentions to be established, as much as is ap-

private anecdote. [It is the business of the Judge

I can not recover the is at present, but I have a strong
notion of having once met with a passage in these
Commentaries where our Author as of himself and
as a matter men are pretty well agreed about,
enumerates the species of animals confirmed under
the word Cattle: They are, if I recollect aright
those of the Horn Ox, Ass, Sheep, Swine and
Goat.

The Office Business of the Judge is to keep the distribution
of valuables, and of reward, and Punishments in the
course of expectation according confirmable to what the applica-
-tion of men concerning them is, or if apprised of those factions the cir-
cumstances of each case, as he is, he supposes
would be. To do that he is to put himself in their
place, and to pronounce from such lights, and from
such lights only, as can appear to them. Suppose
he had a private knowledge of the forgery of a deed pro-
duced as giving Title, and it is unlawful for him to give
evidence
