Privillegium

that purpose: His going, or being carried into
exile, the seizure of his effects. In this view case therefore
it was not an ex past facto Law: it was
not grounded on any special fact preceding: the
facts acts which it commanded, and for the not performing
of which it would have punished, were
acts that were to come after it. The pain it inflicted
on Cicero, was not a punishment: it was
an act of hostility exercised upon an obnoxious
citizen: in short it was a proscription.

NOTE

I know not whether these sort of Laws a Law of the ex-post-facto sort, or a Law of the sort of that by which Cicero
suffer'd was called by "among the Romans" (in general) Privilegium.
I know that Cicero has called it his so. But I
know also that when he called that a privilegium, and
explained it to mean a Law made upon single
persons, and declaimed against it on that supposal
he was at a fault and mistook the his object (of his complaint). He felt that he had been its hard dealt with, but
he saw not how. Nemo unquam tulit, nihil est crudelius, nihil perniciosius,
nihil quod minus haec civitas ferre possit. In this he was Very much mistaken.

(enacted) (if it be that he means,) many had endured
(if that it be that), many have endured since and many will endure.
again. Divorcing Acts are Privilegia. Conveyancing Acts are Privilegia
again. Naturalization Acts are Privilegia. The
Act that give Mr Irwin 5000£ t'other day for
distilling
