one of those noble fruits of self denial, not to be yet
paralleled that I know of in Perry [the History of] of perhaps in
any clime. It is the only one of the
binding principles which men of a certain rank
and education (I am citing a fact and not passing
judgment on it) blush not to avow. It is their
Pure Lamb which our Author in the blindness
of his zeal, would tear from them to make
a sacrifice to his idol. the God of his imagination. I
trust in all humility, that the God of the Universe
means wills otherwise than to exact it.
NOTE
I mean, tho' I hope there are few to whom I
need explain the my meaning the unsollicited surrender of a
valuable [often too valuable] personal privilege. Nothing
like this that I know of was ever done
in any Grecian or in any Roman Senate.
Equity has nothing to do with Statute Law. There
is but one constriction of a Statute. Equity
consists in the establishing exceptions to General
rules of Common Law. Exceptions not to positive
Laws, but to General conclusions from Judicial
practice.
The consideration therefore of Equity should have
been brought subjoined to not after to the account of the
but of the Common Law.
