SECT. VI. Municipal Law
"Add First" then says he, "it is a rule: not and this on three accounts: first to distinguish it from a transient
"sudden order from a superior to a particular person";
but something what it is what a thing it never is: for it is nothing the name belongs to nothing but what is "permanent, uniform and universal".† † p.44.
Hence we learn 3 things. 1st That what is a
First, that what is a rule for one only is not a rule: because it is
not a rule for many. Accordingly he assures us that
"a particular act of the Legislature" (i:e: a particular
Law) "to confiscate the goods of Titius, or
"to attaint him of High Treason, does not enter
"into the idea of a municipal Law". It does not
Into his idea it I suppose, it does not, since he says so: and
he has a right to put into his idea of it what
he pleases: but I fancy it at least it used to enter into other
people's ideas of at least before he took a fancy to have it otherwise.
I am sure it does in Sure I am it does till does into mine.
] [of a] that the
twofold division ⊞ ⊞ On this score therefore From this it seems that upon looking over our Statute book we may learn to on this score make a twofold division of the Laws in it, viz. into into PublicPrivate Laws or Acts
which are not Acts: and into Public ones, which
are.
This that he has instanced we are to observe, he says is rather
a Sentence than a Law: by which he shews it appears that
he knows, as much of the one of them those sorts of them
as of the other. Between a Sentence and a Law It were easy enough, tho' it would take up time, to shew the difference: and hereafter it shall be shewn: but this
is not our business here.
Secondly, we learn that what is a rule at one time for a time only,
