part of that which is called by others and by
him [amongst others called] by him amongst the real
Municipal Law. Common Law, what goes by
the name of Common Law is one such part.† † v. p.63
As to Common Law, where is it prescribed? How
made How can it be prescribed? What is there in
it to prescribe? Who made it? Who expressed
it? Of whom is it the Will? [These are] questions
all these to which he should have had an answer
ready before he spoke of Common Law, as real
Law, part of the Municipal Law, and of Municipal
Law in general, as being a Law prescribed.
"A bare resolution, confined in the breast of the Legislator,
without manifesting itself by some external
sign, can never be properly a law. It is requisite
that tis resolution be notified to the people
who are to obey it, requisite [in order] to who? to its
being a Law did he mean, or [in order] to its
producing the good effects of one? This being the The first of
case these two propositions however being true (as it certain is, Once more what sort of a Law, let
himself him say now himself, is the Law of Nature to part one half
of the Law of Nature?
If by the people he meant all the people, every one
of those who are to it is intended should obey it, and it be requested that
it should be notified to every such person in order to its
being a Law, I doubt we might seek long long enough for
