towards producing pleasure, it to furnish the instrument
of it. But, for pleasure to be produced, the
instrument must meet with the desire. Tho' the Law
should furnish the instrument, it cannot the desire.
It may give a man money: but it had as good
do nothing, if his desire to do the thing it wants
to keep him from, or to let alone the thing it wants
to have him do, is stronger, as it may easily
be, than the money it can have to give him.
But to return to our Author. His account of
the parts of a Law now comes to a conclusion.
And the conclusion is not unsuitable ill-suited ill-fitted to the work.
These parts, thus clearly explained must now be
drawn into competitionset in opposition: and he [is] now undertakes to tell us,
which of them is the most effectual. This, at first sight, is as if
he were to tell us, which of the letters of the word
Law was most significant.
"Of all the parts of a Law", says he, p. 57. "the most
'effectual is the vindicatory. For it is but lost
'labour to say "do this, or avoid that", unless
'we also declare "this shall be the consequence of
'your non-compliance". We must therefore observe
'that the main strength and force of a Law consists
'in the penalty annexed to it. Herein is
'to be found the principal obligation of human
'laws'.
To such a degree is he unfortunate on this head,in this behalfon this occasion
Our Author is more and more unfortunate. The very part that he instances as having
no force of itself, is the only one of them all that has any.
