lawless violence, not from being hurt by a weapon
or any thing else; but simply from being lead
hold of from being apprehended by the ordinary
officers of justice who were Laymen. For this
purpose there might well be a new precise act
of the legislation passed at a given period:
prescribing a remedy against the newly — imagined mischief:
for as to the hurting of a priest by an act of
useless violence, under whatever government it
was, that must all along have been punished, so
long as a priest was deemed a man, [according to the
original usage of the courts whatever they were
of cardinal Judicature.] Thus much at least
seems certain: either this must have been this
purpose of the regulation, to viz: make that force an act legal
regularly legal as being done in pursuance of the process of the law. No longer
legal when exercised on such an object by such known agents: or to make an
act originally illegal, mire penal when committed
on such an object by such hands, that it
was before. According to the 6th supposition only,
which seems the least probable, as the prohibition
is directed so specially to layman, is could the decision
be a proper on one; unless the hurt with
a weapon appeared to have been given to in pursuance of an
attempt to apprehend.
