—"rate acts are rather exceptions than rates, being these
"which operate only upon particular persons, and
"private concerns; such as the Romans intitled Senatas—
"decreta, in contradistinction to the senatûs—consulta,
"which regarded the whole community; + and of these the
"judges are not bound to take notice, unless for—
"mally shown and pleaded. Thus to show the dis—
"dinction, the Statute 13. His. 0. 10. to prevent
"spiritual persons from making leases for longer terms
"than twenty—one years, or three lives, is a
"public act; it being a rule prescribed to the whole
"body of spiritual persons on the nation: but an
"act to enable the bishop of Chester to make a
"lease to A. B. for sixty years, is an exception to
"this rule; it concerns only the parties and the Bish—
"ops successors; and is therefore a private act."
This is our Author's account of a distinction as
useless as it is unintelligible and unsusceptible of any uniform applica—
tion. That it is useless, is a truth our author,
had he seen it, was at liberty to choose whether he would
discover: That it is utterly unsusceptible of any uni—
form application to the individuals it relates to, is a
point of information he was bound to have given,
