B. Ch. Of the Statute Law. The Kinds of Statute enlarging and refraining.
I will suppose, for a moment that the quickest enlarging and
restraining as applied to statutes, instead of being
vague and unmeaning, as they are have a
signification that is determinate. Remedial statu—
te than being divided into enlarging and restor—
ing, two things we are to understand of them.
1st that every statute that which is remedial
(that is, which is not declamatory) is either en—
larging or a restraining one. 2nd that
a statute that is a enlarging one is not a
restraining one: that a statute which restraint
does not enlarge, any more than a statute
which enlarges does restrain.
