the first of them 15 Hen. 7 6. c.5. the other
25 Hen. 8. c.3. I must confess I do not That the latter of these Statutes
to take his account of them, "necessarily
"implies a negative" upon the part former, is
more I confess than I can conceive. What ought
not to pass unnoticed is that a difficulty like
this could not never have happened without but from an unpardonable
contrary carelessness and ignorance: for it, is plain
I think he who penned or who voted the former latter, never could
have thought any thing about the former. The case then
stands thus. Suppose no Statutes passed about
the matter of qualification, the Jury none was
needful, but the first Legislators taking the
matter into consideration thought it fit to require
a qualification, and accordingly appointed 20£. What these Legislators then had
in contemplation was for the first time to establish a qualification
there being none requisite before.

What the 2d set of Legislators had when in contemplation
was also to establish a qualification;
sup not knowing of any that was requisite before.[a]

It was not to reduce it for if it had been they
never could have gone about in this dark and

must therefore have
lain dormant: which
is singular considering
the interest the parties defendants had to execute it. There were Judi whole entire Juries, over
whom the Jurors in question were to sit in Judgment in the heavy prosecution
of an Attaint.
