quoad any thing.
I must leave it to the reader whether what the
conclusion that follows is to be deemed a sufficient
remedy against the poison of what we have been.
"Thus if an man act of Parliament gives a
man power to try all causes, that arise within
his Manor of Dale; yet if a cause should
arise in which he himself is party, the act
is construed not to extend to that; because it is
unreasonable that any man should determine
his own quarrel. But, if we could conceive it
possible for the Parliament to enact, that he
should try as well his own causes as those
of other persons, there is no Court that has power
to defeat the intent of the Legislature, when couched
in such evident and express words, as have no
doubt whether it was the intent of the Legislature
or no." Conceive this possible? why not? To some
indeed this it might be difficult but I see not
what difficulty [in it there can need be to our Author anyone else
who] our author need perceive in it, who sat set out
with telling us what was to be done with acts
that ordaining [requiring what] are impossible to be performed."
I will endeavour to give a clue to The fallacy that runs throughout the paragraph
this. It lurks in the words "reason" and "unreasonable":
