really the intention of the Legislature to give the
Judge a power to try his own cases? Consider
the end of the provision that appointed him. Consider
the benefit proposed from his appointment. Consider
whether his having the power of trying his own causes was were of a nature
to promote that benefit. This if there be room to
doubt whether the Legislator meant to appoint him
or no. If the Legislature has found means to hint
that out of doubt, all reasoning about the end is
out of place.
