Inserenda
Unwritten Law. King no wrong.

Whatever act is wrong in itself, that is in such
men in general if they do it, is one act that can not be done
by him. Whatever act it is he does, is an
act, that which on that very account, because it as he that
does it is not wrong.

An act that is Wrong according to Law, is an act, so noticed
by the Law, as that it appoints a punishment for the
man that does it

To say that an act is wrong, according to Law,
and to say that an act can not be done by
Law, is to sa if applied to the same person, is is in effect one and the same proposition
to say one and the same thing.

This maxim thus conveniently ambiguous, has in turn
served been resorted to by for shelter to opposite parties to shelter
their different pretensions: by the shelters of despotism,
to screen them from the resentment
of the people: by the advocates from for the people
to screen themselves from the displeasure of
the crown. I cannot satisfy myself which
party it was that first constructed it.

NOTE

at p.8
The ground of all legal decisions is realis expediency
rent or supposed. One ground of expediency
is popular expectation: one ground of expectation is past
usage.
