Unwritten Law. Custom. Maxim
Pain [annext by appointment of Law to
acts it holds obnoxious; meaning to prevent
that sort of which they are.] inflicted on account
of acts some act that is obnoxious. All Punishment
then is all Pain that has in any case
been inflicted (understand by appointment
of Law) on account of any obnoxious acts.
[Thus having stated the case] I then took caused all the distinguishable
sorts of acts that the Law had made obnoxious
to pass before me in review. I
took up or formed to myself in imagination
a table of such obnoxious acts; a table
of such acts as had become offences: whether
it was had been that Legislators had made them those sorts of acts punishable
[as such offences] by express appointment, or that
Judges had been used of themselves to punish acts of those the
sorts in question. I ran over the table.
Murder? has there ever been a King punished
for committing Murder? no. For Incendiarism? No. For imprisoning a man's person? no. For cohabiting with another man's wife? no. For seizing another man's land? No.
For taking on any pretence or without pretence
his goods? no. For what And so on. Having
thus proceeded throughout and obtaining always finding ground
the same answer from my recollection always to give the same
answer, to the question concerning every sort
