Common Law. Judicial Decisions
Inserenda
☞ To be inserted at p.13.
No I.
By this the Judge is given to understand, that his business
is to look not to his proceedings themselves, but to the
name he gives them. If he meets with a decision
he does not like, so, it is well: he may overthrow it at his
pleasure. Only let him be sure he does not say
it was bad law: let him call it no law, and
everything is as it should be. This sort of discourse
which our Author would have us understand is constantly
employ'd upon such occasion, he is very desirous
we should look upon as a master-piece of policy,
as upright as it is refined.[a]
NOTE
[a] This policy seems to be the same hand [with] that [which]
if modern history saith true, was observed is want to be by a certain
Jew. This Jew happen'd by misfortune to have a
Christian relish for Westphalia Hams: at the same
time that he was a devour observer of the Law. To
bring his religion to be upon good terms with reconcile his religion conscience with his palate
he took a method with these Hams [bethought himself of an expedient.]. He christen'd called
them stock fish; and with the said stock fish (retaining always his aversion
for the flesh of swine) did he fill his Belly belly.
Upon the same principle it is that many a good
Mussulman, who abhors the very name of wind, finds
means to amuse himself with brown water. This
in short is what in vulgar phrase goes by the name of "cheating
of the Devil".
