Common Law. His Reports and Treatises.
The contents of the What is deliver'd by our Author under this head is
a consists of a short statement of certain matters of fact:
These matters of fact are in themselves notorious; nor does is there
seem any thing very remarkable particular in the colouring [he has
given them] We I shall therefore pass them over They may be passed over therefore
therefore with comment.
Of the two next paragraphs the business is to give
us a cursory view of the treatises we have extant on
the subject of Common Law. These our Author
might have divided into historical narratory and argumentative:
historical being such whereof the purport is
simply to relate what has been done such and such decisions
as having passed by Judges the have such and such particular transactions of as having passed
in Courts of Justice; argumentative the purport of
which is, to lay down of Law from the
consideration of those particular transactions, to lay down general
rules of Law; as either having taken or being likely to
take place.[a]⊞ ⊞[a] To p.7.
Those which we have termed historical are known
by the particular name of Reports. The others are comprehended
under the general name of Treatises.
In With respect to these Reports and Treatises, what our Author
here says of them, consists as one might expect was was to be expected
of a simple statement of matters of fact: viz: that
there are such and such Reports and Treatises.
These matters of fact it is easy to see, must be
in themselves notorious: nor is there any thing very
