Common Law. Reports and Treatises.
What is that locus? this our Author, with very
good reason has not taken upon him any otherwise than by approximation to determine
"One of the last" "whose treatises are authority is see Sir
"Edw. Coke". It is Coke's last treatise was written
in 1628. The very last? this he does not say.
Sr M. Hale died in 16... This in point of time
is o inconsiderable distance. Yet will would our Author
or undertake to say that Hale's while Coke's is perfect authority
and that is perfect, Hale's is none at all? I believe
hardly. I believe there is no one who would find it
an easy matter to determine with himself that the
authority of Hale, (I mean even in the particular sense
here given to the word authority by our author to the word of authorities,)
is at all inferior, much less to what degree it is
inferior, to that of Coke.
