Common Law. Law Roman.
I [This is a point [it is observable has been laboured by our Author]
we may observe our Author labouring with no
reference anxiety earnestness in more places of pages than works
than this⊞ ⊞ labouring with no small earnestness sollicitude. It is common to observe with what [earnestness and] anxiety this point is laboured.; on what account one can to what purpose it is difficult
to say, unless by way of defense against it have been in the view of battling the enterprizes pretensions
or apprehended pretensions of the its rival [Civil Law Professors:]
those rival dispensers vendors of legal doctrine, Juridical instruction, who, in
his nor anxious apprehension might be disposed to set up vaunt
their wares to the prejudice disparagement of his own.[a] [a] v. NOTE at p.3. ⊞ ⊞ I can devise no other. For what man or set of men whose will carried with coercion. For what
assembly branch of the Legislature, or what sovereign court
of Judicature for some hundred years ever dreamt of allowing the Civil Law
courts an in independent power, or the Jurisprudence
written or unwritten that is adopted by them an independent, intrinsic authority,
it would I believe be difficult to say. For
my part, that I may thus far joint hands with our Author, I abhor them⊞ ⊞ I profess, as cordially as a man need to, for the pow with sufficient cordiality for the power that which they
have: but I am not the least am I afraid of them,
as likely to get more.[b] [b] v. NOTE at p.2. While as yet we had no knowledge
of our own, even from thence something was to be got perhaps by going a begging, it might be necessary of advantage to go a begging.
But I trust that by this time we have were the work to be done anew, we might by this time, at least, know full as
better well how to make provision in matters of
marriage Tribunals and Demonstration and Succession, than a the
titled slave of a Justinian or Justinians a Gregory, magnifies could have told teach
us: and I regret the dismay at Amalfi if I do not absolutely wish that there never had
been a will an Amalfi[c] [c] v NOTE at p.3. to give up yield forth their works, I wish should
not be sorry, I must confess, if of this time of day could I find a in
there were there some [other in that pit to inter them] Vesuvius to that should consume them. But I am not in the least
apprehensive of Popes and Emperors doing more mischief
in this country than they have done.
No small mischief, I take it is that, which was in this country has been done by Roman Emperors and Roman Popes: but bating the continuance of what remains; I am not in the least apprehensive of their doing more.
