is used, it means real Law, that as Written Law means an assemblage of certain symbols containing an expression of the
Will of a certain person or persons of whose will it purports
to give an account, viz. of a person having authority to cause his will to be obeyed in the State in which it [post] offices, by that other person or those
persons themselves actually really as such delivered. In short In
this sense it short, it signifies the authoritative expression of the will
of a Legislator in general generally: in contradiction to
Unwritten Law, which [in this case] is not the authoritative
expression of the Will of any Legislator.
In the second sense it means the authoritative expression
of the supreme Legislator of the that State [in question]
in into which it is considered as [subsisting] having been
received adopted [imported]. Now then in the first of these

The truth is the Common Law properly so called
considered if by it we mean any collection of words, is
the expression of the supposed Will not of any Legislator
but of certain Judges, yet not delivered uttered by
so much as by those those Judges. The Civil Law (a part of it) considered in itself is the
expression of the Will of a certain Legislator, & delivered
by that very Legislator of whose Will it
purports to contain give an account: considered as introduced
in this country by Judges, it is still the expression of a
Legislator to wit that Legislator as before, but put
in force not on account of it being expressing the will of
that Legislator, but on account of it's expressing the
Will of those Judges who by adopting it that will in the words in which it is expressed, have
made the expression of it that Will the expression of their own
