two senses the assemblage of words we speak
of when we say the Civil Law is part of it written part of it not written unwritten. In the 2d it is none of
it as written: except such part of it as is made to
by
made written (so we must speak) by the h express adoption of
words of adoption utter'd by the Legislature, and this part may
as well be of the sort that which in the 1st sense is called termed
unwritten, as of the other that is called written

I think it is plain these unhappy words "written"
and "unwritten" can never answer the purpose of
conveying any those ideas as applied to the objects they
are here put to characterize. To clear up the
confusion to satisfaction we must find out some other pair of words:
let this other pair be authoritative and unauthoritative:
Authoritative for written, unauthoritative
for unwritten.

We are considering Law all this which, it is to be observed as an assemblage
of certain words; not merely an assemblage
of modes of conduct of a ruling power body, nor of bare ideas
nameless ideas of such an assemblage modes of conduct,
but an assignable assemblage of certain words.

This being promised, By Law authoritative I mean an assemblage
of words purporting to express the Will of a Legislator,
and by express acknowledgement declaration acknowledgement delivered by
given delivered by him as for such.
