Civil Code
☞ This code proceeds from simple to complex. Bonaparte's begins with
complex. de drots civile thence of Instructional two and employs the fiction
mode civile.
Tit. 1
Tit. 1. Of Persons simply considered: i.e. without reference to things
Art. 1. Every person is entitled, at the hands of
every other, to those negative services which consist in abstinence
from offences injurious to his person to him in respect of person,
reputation, property, power and condition in life. For As to these
see the Penal Code.
Art. 2. Every person is entitled at the hands of
every other person to those eventual positive services the non-reddition
of which would respectively constitute a negative offence. As
to these see in like manner the Penal Code.
Art. 3. Without reference to things, services may
be due from person to person in by virtue of contract.
Examples are
1. Medical relief
2. Sport or pastime certain species
3. Sexual intercourse. The contract of which this is the
subject is called marriage.
Art. 4. In civilized society, marriage not being ever
contracted but between person soles, one or both of them, are a possession
or property or in contemplation of becoming so. The
law as to marriage is therefore deferred till after the consideration
of the various sorts of things considered as the subjects subject matter of property.
Art. 5. A Every person is a subject matter of property in so to a
far as he stands bound to render service in any shape certain extent: that is to say, to the extent of all such services as in any
shape he stands bound to render.
Art. 6. A Services of such a nature that their being
obligatory or the sources of obligation correspondent compensational obligation may
have place without contract will come to be considered coincidentally
to services rendered due by contract.
