At the opening of a Civil or say Rights Conferring
Code
, the first thing for consideration is the order in
which the matter of it shall be disposed.

The order of time will, on this occasion, take
the lead and serve for guidance.

In the first place then, will come to be considered
the manner in which rights are originally
acquired & brought into existence: in the next place,
the manner in which some are extinguished,
and in which those which are not extinguished pass
from the hand of the original acquirer into other
and other hands.

But these same things called rights what
are they? And by what means are they brought into
existence?

In the first place, for every right there must
be a possessor – a subject matter – a person or set
of persons as against or at the charge of whom
they are possessed, and a correspondent set of obligations
by the absence or presence of which they are
created.
