Civil Code
For the subject matters of right, we have
1. The body of the right-holder.
2. The mind of the right-holders the two conjointly
designated by the word person.
3. His reputation.
4. His property.
5. His condition in life.
In so far as the subject matter of right is a man's
body, the right consists in the being exempt from
wrongs – from wrongs by which his body would be
put into a state of sufferance. And the right is conferred
or carried into effect by an obligation of the
negative kind, imposed upon other persons in general
– a negative obligation, the obligation of abstaining
from the producing, in his instance, any such
sufferance.
So likewise in the case of those rights
which have for subject matter his mind.
So likewise those which have for subject
matter his reputation.
As to those which have for their subject
matter his condition in life, they are of
so complex a nature, that they can not receive
consideration till those of the three
former classes have been considered.
