Now as to those rights which have property
for their subject matter.
The subject matters of property are of two classes
viz. persons and things. In so far as slavery
is admitted, persons may become, in as full a manner,
the subjects of proprietary rights as things themselves
can be. But in so far as slavery is excluded
or mitigated, that which is considered and
spoken of as a subject matter of proprietary rights,
is not the person himself who is in question, but
i.e. not all the services negative and positive
which might be capable of being elicited from him,
but only certain services of a limited and determinate
description: services which will respectively
require to be designated by specific
and appropriate denominations.
Secondly as to things. These will require to be distinguished
in the first place into things corporeal real or say
really existing – 2 Things incorporeal fictitious, imaginary objects
or subject matters which the imperfections of language
necessitates us to imagine to ourselves, and
speak of as if they had existence in the same
manner as those tangible and otherwise perceptible
objects, which we comprehend under the general
denomination of things.
