Civil Code
(4)
Of things real, the first division is into
things immoveable and things moveable.
Of these two sorts of things, the first is that
in which, in the order prescribed by time, claims
the precedence: things immoveable being those
from which all things moveable derive their existence.
In the case of things immoveable, the first object of
consideration is, the sorts into which they are distinguishable.
In the case of things im moveable, the sorts into
which they are respectively distinguishable, regard being
had to the sorts of things into which the things immoveable
from which they have been derived, have
been distinguished.
Things immoveable – their species – 1st Things natural
– 2 Things artificial – 3. Things natural, artificially
modified.
Of things immoveable in their natural state,
the first division is that into portions of land. 2d – portions
of water, so called for shortness, instead of saying
portions of land covered by water; always remembered
that there are some portions of land which are
at times in the uncovered at other times, in
the covered state.
Of portions of land, there are some, the elementary
parts of which are of themselves valuable to man
being applicable to his use: others, no otherwise than
in respect of the existence and support which they
give to things of a different nature from themselves,
& which are distinguished from them & from each
other by the appellations of vegetable and animal –
thence the division distribution of all things real under the 3 heads called
Kingdoms, mineral, vegetable & animal.
