Judges' tutelary functions.
Instructions to the Legislator.
Under the tutelary care of the Judicial authority two three
classes of objects are brought by the nature of things – namely persons and things and foundations, are necessarily
brought by certain appropriate events: persons, by
relative mental imbecility: things, by absence non-forthcomingness of the appropriate proprietors.
Mental imbecility may be produced by infancy, by endurity, by insanity:
absence non-forthcomingness of the appropriate proprietors is may be produced
by death, insolvency, abuse legal sequestration, absentation. By a
case of absentation understand a case in which by a person being absent
whose residence or course of travelling extent intended as well as
actual, is unknown, property has been left without the
known existence of any other person who by law is entitled to
take care of it: that is to say to exercise with relation to it.
Foundations are are brought placed under the guardianship of the
judicial authority by demand in two shapes in the necessity of the case on two grounds, for two
purposes: to prevent the funds from being altogether wasted: 2. to
prevent them from being applied to purposes other than those to
which the founder declared them to be applied: those purposes
being perceived to be such as the law tolerates it best if it does not either approves or tolerates
positively approves
